Under the decision, executives and agents cannot work in the administration of the Ivey, while receiving compensation from a non-governmental organization for work performed for the state. The executive order also prohibits an executive or agent from asking a private body to make available to the State a loaned staff member or to demand compensation from a private body for the work done for the state. Ivey issued a press release today saying that the executive order is a continuation of its efforts to “open and transparent management.” The loaned executives will serve a maximum of one year as unpaid employees of the department. Loaned Executive Program is a special (unpaid) opportunity for private sector talent to share their expertise with DHS. The department works with the private sector on innovative solutions to our internal security challenges under the program. Homeland Security is looking for senior executives and industry experts across the country who work with us if we strive to solve problems, improve processes and carry out our mission. The first appointments are made for a period of at least three months and no more than one year. The loaned board of directors may be reconstituted for additional periods with a total order of no more than two years. Applicants follow an orientation and training program prior to the start of their assignment. Wages and expenses are the responsibility of private sector employers. The loaned executive will report to the office of its respective DHS component in the National Capital Region (Washington, DC). One of the persons quoted was that it was not illegal for someone who acted as a government employee to be paid by a private agency. Special prosecutor Ellen Brooks said it was unclear how the state`s ethics law would apply to “loaned executives.” The executive tasks borrowed are hosted by DHS components, and responsibilities may vary.
